Honourable President,
The
verdict given by the Supreme Court on the 16th October,
after considering three petitions filed by our party states
that the merger of the Northern and Eastern Provinces by a
gazette notification using executive powers of the President
was illegal and the right of the people in the North and the
East to vote has been denied by it. Hence, it is evident
that the North & East provincial council cannot legally
exist any more.
There
are numerous subjects that come under provincial councils
under the 13th amendment to the constitution. These subjects
in the Northern & Eastern provincial council have been so
far carried out by N/E provincial council with the guidance
of the Governor. As the N/E provincial council gets
abrogated in view of the verdict of the Supreme Court, it
would be necessary to establish separate public institutions
to carry out these subjects. Avoiding the establishment of
these institutions would lead to gross instability in the
relevant provinces.
The
strength of separatist tiger terrorists in the Eastern
Province has diminished considerably. This advantageous
situation could be used to establish democratic institutions
in that province. What is needed is to take necessary steps
to establish those institutions. The same measures could be
used in the Northern Province as well after the necessary
environment is created in that province.
However, The Government under your leadership doesn’t seem
to have paid any attention to this. There hasn’t been any
official statement on any measures to be taken regarding
this since the verdict given by the Supreme Court. Failing
to take new decisions with regard to the new situation
created by the verdict given by the court would politically
destabilize the North and the East. Only the separatist
tiger terrorism would gain by it.
Hence,
we would like to request you to consider all these matters
and establish democratic institutions of elected
representatives in the North and the East and by doing so
take measures to dispel instability in those regions.
The
merge of the Northern and Eastern Districts by Indo-Sri
Lanka pact in 1987 on the mythical concept of ‘Tamil
historical homeland’ has been shattered by the historic
judgment given by the Supreme Court. However, there is a
move by certain forces to pressurize your Government to
merge these provinces again. We would like to request you
again to immediate steps to establish democratic
institutions in the North and the East without being a prey
to those forces hostile to the country.
We
would appreciate if you would mediate immediately regarding
this.
